Amazonもやっぱり、「アナロジー(類推)で考えてはいけない」


気分一新で、Amazonの話しをしましょ。


Stanford Technology Law Reviewっていう「ロー・レビュー」があんだよね。


そこで、Jonathan Kerry-Tyermanさんのこんな論文が発表されてる。

このタイトルは、とっても洒落てんだけど、和訳がひじょーに難しい。アナログ思考(Analog)とアナロジー(Analogue)がひっかけられてて、意味からすると、「アナログなアナロジーで考えんな」ってことなんだけど、数ヶ月たった今でも適当な訳が思いつかん。「国語力」の限界を感じる。


さて、肝心の内容は、というと、

This paper begins with an overview of Amazon's prior experiments with e-books, the way in which the Search Inside the Book database is created, and how that database manifests itself to the Amazon user.

というわけで、最初はAmazon史の簡単な紹介だね。ここまでは、たいしたことない。でも、読んでみてもいいかも。


ところが、話は豹変する。

Part II analyzes the Search Inside the Book program under current copyright law and concludes that the program does infringe copyrights in the indexed works.

というわけで、「Amazonの"Search Inside the Book"は、著作権を侵害(infringe copyrights)しとる!」、って言い出す。(法律用語は詳しく知らんので、あまり厳密に受け取らんでね。)


どんくらい「侵害してる」かっていうと、

Search Inside the Book, which requires the copying and distribution of the entire text of copyrighted works, implicates the copyrights in those works.・・・ Amazon has not secured adequate permission from copyright owners to engage in this copying and distribution. Furthermore, Amazon’s current implementation is not a fair use of these works, nor is it subject to any other limitation or affirmative defense. “Search Inside the Book” therefore constitutes copyright infringement on a massive scale.

ということで、「全ての許可をもらってるわけでもないし、"fair use"にも、"any other limitation"にも、"affirmative defense"にも該当しないので、すご〜く(on a massive scale)侵害してる!」んだって。さらに、本文では、「Amazonの"Search Inside the Book"で、本をまるごと1冊ダウンロードする方法」が紹介されてて、こんな欠陥があるんだから、"fair use"という武器は使えんよ、って言ってる。(でも、こんなところで紹介されてるくらいだから、Amazonも対策済みだろうけどね。)*1


Amazonの"Search Inside the Book"は、著作権をすご〜く侵害してるんだけど、

Part III argues that programs like Search Inside the Book, though infringing, actually serve the purposes of copyright law, and should not create liability for the providers of such programs.

というわけで、「だからダメだってわけじゃない!」と救いの手をさしのべる。論点としては、もう一度、copyrightの趣旨に立ち返ってみて、

Provided that the current technological deficiencies are rectified, the index merely allows users to find books they otherwise would have missed, fostering rather than supplanting book sales.

ということで、「埋もれてた本が見つかって、買われるかもしんないんだから、いいじゃん」という、まぁ、かなり「そんなこと、どこにでも書いてあるよ」って内容を書いてる。でも、法的な側面をちゃんと整理した、って意味ではいいかもしんない。


そんで、最後に

Finally, part IV applies the fair use doctrine to Search Inside the Book, assuming that the existing copy-protection measures are improved as indicated and ultimately finding this unconventional program protected as fair use.

というわけで、「Amazonの"Search Inside the Book"は、前代未聞の新サービスだから、びっくりしちゃったけど、"fair use"の範囲を拡大すればいいんじゃない」ってこと。具体的には、

Under the current law, the fair use affirmative defense provides a non-exclusive list of several types of use that may be permissible, such as criticism, comment, scholarship or research. The use made by Amazon in Search Inside the Book, the creation and implementation of digital information location tools, should be read into the existing copyright statute as an additional form of fair use.

というわけで、「現在のところ、"fair use"に該当すんのはcriticism、comment、scholarship、researchの4つだから、Amazonの"Search Inside the Book"は該当しない。だけど、"fair use"が時代に合わせて拡大されて、"digital information location tool"って感じで"fair use"認定されていいんじゃない」と書いてる。ただし、現在の技術的な問題点が全て解決される、という前提でね。*2


さらに、"fair use"を判定するための4つの観点(条文はこっち、解説はmemorandumさんを見てね)について、細かく検討して、

  • The Nature of the Use: This first factor thus weighs strongly in favor of a finding of fair use. (無問題)
  • The Nature of the Copyrighted Work: This factor weighs against a finding of fair use. (有問題)
  • The Amount and Substantiality of the Portion Used: This factor therefore weighs in favor of a finding of fair use. (無問題)
  • The Effect of the Use on the Copyrighted Work: Under this fourth factor, assuming that Amazon strengthens its anti-copying measures as described above, the proven benefit to the original market and the copyright policies favoring this type of derivative use point clearly to a finding of fair use. (条件付無問題)

ということで、「4つのうち、3つはクリアされているか、されるだろうな」ってことなんだって。だから、いいじゃん、ってことらしい。


Jonathan Kerry-Tyermanさんの結論として、

Search Inside the Book, however, is not a library. It is an index to copyrighted material, allowing the public to find information buried deep within the pages of printed books, efficiently and effectively, for the first time in history. Amazon should ensure that this remains its function by correcting the flaws in its implementation, and courts should allow this new and productive use to flourish as Congress intended under the protection of the fair use doctrine.

というわけで、「アナログなアナロジーで考えんな(No Analog Analogue)!"Search Inside the Book"は見るためじゃなくて、探すための道具だぞ!確かに運用面でいくつか問題点があるのは分かっとるが、直していけばいいじゃないか。なんのために、"fair use"って例外ルールを作ったのか、思いおこそうぞ!そんで、この新しいサービスを"fair use"の範囲だと認めてやろうじゃないか。みんなのためになるぞ」って言ってる。


ところで、Jonathan Kerry-Tyermanさんって、(やたらと長い名前だけど、)信用できんの?


おそらくね。だって、あの「国会図書館」の「カレントアウェアネス」が、情報仕入れに使ってる「Open Access News」っていうブログでも2月17日に、

Full-text search indexing helps copyright holders, should be lawful

って感じで取り上げられてっから。根拠はそんだけ。


まぁ、そんなこんなで、何が言いたいかって言うと、「本の電子化ってのは、著作権をめぐる論争とセットだね。(というより、YouTubeも含め、米国の諸ビジネスは、著作権論争に代理される「ビジネスモデル競争(a clash of business models)」に入ってたんだね。)AmazonGoogleも、武器としてはフェアユース("fair use")を持ち出してんだから、ちょっと知っとかないとね。Jonathan Kerry-Tyermanさんは有名でも権威でもなさそうだけど、入り口としては良いと思う」ってこと。


また、Amazonのプロジェクトってのは、スキャン技術としてはかなりオーソドックス(古くさいってことね)ですご〜くつまらん。けど、著作権や「本ってものの考え方」について、やっぱり、「アナロジー(類推)で考えてはいけない」のかも、と思わせるようないろんな話題を提供してくれる。だから、そんな意味で、Amazonは注目しとかんとね。


ところで、日本のアマゾンは、どんな理論武装してんのかな?それとも、まさか丸腰?

*1:この章に関して注目したいのは、「The modern publishing contract typically also contains a provision dealing with the license of electronic rights and rights derived from "technologies not yet known."」というわけで、「出版社と作家の間の契約では、"将来の技術"によって発生するかもしんない"権利"について書かれた条項がある」んだって。そんで、そんな「あいまい」な条項のせいで、もめごとになるんだそうだ。特に、「本をスキャンしたら誰が売っていいの?("who owns the rights to sell digital versions of previously published books.")」ってのが、実際に裁判所で争われた、とのこと。

*2:この技術的な問題点ってのが、ちょいとばかしおもろい。そのうち詳しく紹介するけど、しばらく、23ページあたりを読んで楽しんでね。
