Googleのカウンターパンチ（Subpoena）をちゃんと見てみよう
Googleスキャンプロジェクトは、著作権問題で大きなダメージを受けたかのように見えてたよ。でも、Subpoenaは、起死回生のカウンターパンチになるんじゃないかなって考えてる。だから、Amazonシリーズ中断しとんよ。そんでこの記は、お茶を濁さんよ。Subpoenaを紹介した以上、ちゃんと中身も紹介する。
このSubpoena手続きの書類冒頭、
YOU ARE COMMANDED to produce and permit inspection and copying of the following documents or objects at the place, date, and time specified below (list documents or objects): See Schedule A
PLACE: Yahoo! Inc., 701 First Avenue, Sunnyvale, CA 94089
DATE AND TIME: October 20, 2006 10:00a.m.
ってわけだから、「10月20日の朝10:00までに、Schedule A（添付資料Aってことね）に書かれた書類を全部用意せんとあかんよ」ってこと。しかも裁判所からYahooへの「命令（COMMAND）」ね。Microsoftに対しても、同じね。
そんで、肝心のSchedule Aだけど、
12項目あって、例えば第1項は、
1. Documents sufficient to describe the Yahoo Book Project, which should include documents concerning (a) the creation or acquisition of an electronic or digital copy of the book, (b) the creation of an electronic or digital index of each book, (c) the amount of each book Yahoo has made or has plans to make available to the public for searching through an internet search engine, and (d) the index and search features of the Yahoo Book Project.
ってわけで、「Yahooが本のスキャンプロジェクトで、どの本をどんくらいスキャンするつもりなのか、分かるように説明しろ！」という「命令」だし、第2項は、もっと細かくて、
2. Documents sufficient to show the title, author, copyright status, and copyright owners (a) of books currently available to the public through the Yahoo Book Project, and (b) if books that Yahoo has plans to make available to the public through the Yahoo Book Project before December 31, 2009.
って感じで、「スキャン対象の本全てに対して、タイトル、作者、著作権の状況、著作権を持ってる人が分かる書類を用意しろ！」って「命令」。
あと、「Googleってやるな」って思ったのは、第6項で、
6. Documents sufficient to show the security, access controls, user restrictions or digital rights management controls You have used or that you have considered using in connection with the Yahoo Book Project to prevent a piracy of a copyright book.
って感じで、「著作権保護のために、どんなアクセスコントロールやってんのか、分かる書類を用意しろ！」っていう「命令」。実は、最近ハヤりの大量スキャンプロジェクトってのは、あんだけの大量スキャンが前代未聞だってこともあるけど、アクセスコントロール（DRM)ってのも結構「未聞」級だよ。各プロジェクトが競ってるフィールドってことね。
その他、（時間がないから、全部を紹介することできんけど、）「プロジェクトの予算を教えろ！」だとか、「どの図書館と交渉中なのか教えろ！」だとか、やりたい放題。でも、Subpoenaとして、裁判所が認めたんだから、YahooとMicrosoftは10月20日までにちゃんと用意せんと、尻たたかれる。「命令」だからね。
すごい中身でしょ？全12項目の書類が手に入ったら、他社のプロジェクトの全〜てが分かるわけ。こんなカウンターパンチを考え付いたGoogle弁護士軍団は、やっぱりすごいな。梅田さんがYouTube買収に対して、「Googleがきちんと「正しい経営判断」を下す会社になったんだなぁ」*1という感想を書いてんけど、プラス、「Googleはとんでもない弁護士集団まで用意してて、技術、経営、法律のすごーい集団になったんだなぁ」と思った。
とりあえず、10月20日に、どんなことになるのか、楽しみだよ。
